Below you will find an overview of the legal bases of the GDPR, on the basis of which we process personal data. Please note that in addition to the provisions of the GDPR, national data protection requirements may apply in your or our country of residence or domicile. Furthermore, if more specific legal bases are relevant in individual cases, we will inform you of this in the Privacy Policy.

Einwilligung (Art. 6 Abs. 1 S. 1 lit. a. DSGVO) – The data subject has given their consent to the processing of their personal data for a specific purpose or for several specific purposes.

Vertragserfüllung und vorvertragliche Anfragen (Art. 6 Abs. 1 S. 1 lit. b. DSGVO) – Processing is necessary for the performance of a contract to which the data subject is a party or for the implementation of pre-contractual measures that are carried out at the request of the data subject.

Berechtigte Interessen (Art. 6 Abs. 1 S. 1 lit. f. DSGVO) – The processing is necessary to safeguard the legitimate interests of the person responsible or a third party, unless the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data, outweigh this.

National data protection regulations in Germany: In addition to the data protection regulations of the General Data Protection Regulation, national data protection regulations apply in Germany. This includes in particular the law on the protection against misuse of personal data during data processing (Federal Data Protection Act – BDSG). The BDSG contains in particular special regulations on the right to information, the right to erasure, the right of objection, the processing of special categories of personal data, processing for other purposes and transmission as well as automated decision-making in individual cases including profiling. It also regulates data processing for the purposes of the employment relationship (Section 26 BDSG), in particular with regard to the establishment, implementation or termination of employment relationships and the consent of employees. Furthermore, state data protection laws of the individual federal states can be applied.

Safety measures

We take appropriate technical and organizational measures in accordance with the legal requirements, taking into account the state of the art, the implementation costs and the type, scope, circumstances and purposes of processing as well as the different probabilities of occurrence and the extent of the threat to the rights and freedoms of natural persons to ensure a level of protection appropriate to the risk.

The measures include, in particular, securing the confidentiality, integrity and availability of data by controlling physical and electronic access to the data as well as the access, input, transfer, ensuring availability and their separation. Furthermore, we have set up procedures that ensure the exercise of data subject rights, the deletion of data and reactions to the threat to the data. Furthermore, we consider the protection of personal data already in the development or selection of hardware, software and procedures in accordance with the principle of data protection, through technology design and data protection-friendly default settings.

Transmission of personal data

As part of our processing of personal data, it can happen that the data is transmitted to other bodies, companies, legally independent organizational units or persons, or they are disclosed to them. The recipients of this data can include, for example, service providers commissioned with IT tasks or providers of services and content that are integrated into a website. In such a case, we observe the legal requirements and, in particular, conclude corresponding contracts or agreements that serve to protect your data with the recipients of your data.

Data processing in third countries

Insofar as we process data in a third country (i.e. outside the European Union (EU), the European Economic Area (EEA)) or the processing in the context of the use of third-party services or the disclosure or transfer of data to other persons, offices or companies takes place, this is only done in accordance with the legal requirements.

Subject to express consent or contractually or legally required transfer, we only process or have the data processed in third countries with a recognized level of data protection, contractual obligation through so-called standard protection clauses of the EU Commission, in the presence of certifications or binding internal data protection regulations (Art. 44 to 49 GDPR, Information page of the EU Commission: https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection_de).

Deletion of data

The data processed by us will be deleted in accordance with the legal requirements as soon as the consent permitted for processing is revoked or other permissions are no longer applicable (e.g. if the purpose of processing this data is no longer applicable or is not required for the purpose).

If the data are not deleted because they are required for other legally permissible purposes, their processing will be limited to these purposes. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be stored for commercial or tax law reasons or whose storage is necessary to assert, exercise or defend legal claims or to protect the rights of another natural or legal person.

Google is one of a third-party vendor on our site. It also uses cookies, known as DART cookies, to serve ads to our site visitors based upon their visit to www.website.com and other sites on the internet. However, visitors may choose to decline the use of DART cookies by visiting the Google ad and content network Privacy Policy at the following URL – https://policies.google.com/technologies/ads

Use of cookies

Cookies are text files containing data from visited websites or domains and are stored by a browser on the user’s computer. A cookie is primarily used to store information about a user during or after their visit to an online offer. The stored information can include, for example, the language settings on a website, the login status, a shopping cart or the place where a video was watched. The term “cookies” also includes other technologies that fulfill the same functions as cookies (e.g. when user information is stored using pseudonymous online identifiers, also referred to as “user IDs”).

Provision of the online offer and web hosting

In order to be able to provide our online offer securely and efficiently, we use the services of one or more web hosting providers from whose servers (or servers managed by them) the online offer can be accessed. For these purposes, we may use infrastructure and platform services, computing capacity, storage space and database services, as well as security and technical maintenance services.

The data processed as part of the provision of the hosting offer may include all information relating to the users of our online offer that arises in the course of use and communication. This regularly includes the IP address, which is necessary in order to be able to deliver the content of online offers to browsers, and all entries made within our online offer or on websites.

Collection of access data and log files: We ourselves (or our web hosting provider) collect data for every access to the server (so-called server log files). The address and name of the retrieved websites and files, date and time of retrieval, amounts of data transferred, notification of successful retrieval, browser type and version, the user’s operating system, referrer URL (the previously visited page) and, as a rule, IP Addresses and the requesting provider belong.

The server log files can be used on the one hand for security purposes, e.g. to avoid overloading the server (especially in the case of abusive attacks, so-called DDoS attacks) and on the other hand to ensure server utilization and stability.

Cloudflare We use the “Automatic Platform Optimization” service. The provider is Cloudflare Inc., 101 Townsend St., San Francisco, CA 94107, USA (“Cloudflare”). Cloudflare offers a globally distributed content delivery network with DNS. Technically, the information transfer between your browser and our website is routed via the Cloudflare network. This enables Cloudflare to analyze the traffic between your browser and our website and act as a filter between our servers and potentially malicious traffic from the Internet. Cloudflare can also use cookies or other technologies to recognize Internet users, but these are used solely for the purpose described here. The use of Cloudflare is based on our legitimate interest in providing our website as error-free and securely as possible (Art. 6 Para. 1 lit. f GDPR). Data transfer to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://www.cloudflare.com/privacypolicy/. Further information about security and data protection at Cloudflare can be found here: https://www.cloudflare.com/privacypolicy/.

Content Delivery Network

To optimize the loading times of this website, BunnyCDN is used as a content delivery network (CDN). Static files used on the website, such as images and script files, are provided by the BunnyCDN network. All personal data is anonymized and not transmitted to third parties. BunnyCDN does not collect, store or distribute any information that could be used in any way to identify users or contain their personal information. For more information about how BunnyCDN handles data, please visit the BunnyCDN website at https://bunnycdn.com/gdpr and https://bunnycdn.com/privacy. The use of BunnyCDN is in the interest of a uniform and attractive presentation of this website. This represents a legitimate interest within the meaning of Article 6 Paragraph 1 Letter f GDPR.

Blogs and publication media

We use blogs or comparable means of online communication and publication (hereinafter “publication medium”). The data of the readers are processed for the purposes of the publication medium only insofar as it is necessary for its presentation and the communication between authors and readers or for reasons of security. In addition, we refer to the information on the processing of visitors to our publication medium in the context of this data protection notice.

Comments and Posts: When users leave comments or other posts, their IP addresses may be stored based on our legitimate interests. This is for our security if someone leaves illegal content in comments and posts (insults, forbidden political propaganda, etc.). In this case, we can be prosecuted for the comment or contribution and are therefore interested in the identity of the author.

Furthermore, we reserve the right to process user information for the purpose of spam detection on the basis of our legitimate interests.

On the same legal basis, in the case of surveys, we reserve the right to store the IP addresses of users for the duration of the survey and to use cookies to avoid multiple votes.

The personal information provided in the comments and posts, any contact and website information as well as the content will be stored by us permanently until the user objects.

Contact and request management

Within the framework of existing user and business relationships, the details of the requesting persons are processed to the extent necessary to answer the contact requests and any requested measures.

The answering of the contact inquiries as well as the management of contact and inquiry data within the framework of contractual or pre-contractual relationships takes place to fulfill our contractual obligations or to answer (pre)contractual inquiries and otherwise on the basis of the legitimate interests in answering the inquiries and maintenance of User or Business Relationships.

Onlinemarketing

We process personal data for online marketing purposes, which may include the marketing of advertising space or the presentation of advertising and other content (collectively referred to as “content”) based on the potential interests of users and the measurement of their effectiveness.

The IP addresses of the users are saved. However, we use available IP masking procedures (i.e. pseudonymization by shortening the IP address) to protect users. In general, no clear user data (e.g. e-mail addresses or names) are stored as part of the online marketing process, but pseudonyms. This means that we and the providers of the online marketing process do not know the actual identity of the users, only the information stored in their profiles.

In principle, we only receive access to summarized information about the success of our advertisements. However, we can use so-called conversion measurements to check which of our online marketing processes have led to a so-called conversion, i.e. e.g. to the conclusion of a contract with us. The conversion measurement is only used to analyze the success of our marketing measures.

Unless otherwise stated, please assume that cookies used will be stored for a period of two years.

Notes on legal bases: If we ask users for their consent to the use of third-party providers, the legal basis for processing data is consent. Otherwise, user data is processed on the basis of our legitimate interests (i.e. interest in efficient, economical and recipient-friendly services). In this context, we would also like to draw your attention to the information on the use of cookies in this data protection declaration.

We include so-called affiliate links or other references (which may include e.g. search masks, widgets or discount codes) to the offers and services of third parties in our online offer (collectively referred to as “affiliate links”). If users follow the affiliate links or subsequently take advantage of the offers, we may receive a commission or other benefits from these third-party providers (collectively referred to as “commission”).

In order to be able to track whether the users have taken advantage of the offers of an affiliate link used by us, it is necessary for the respective third-party providers to know that the users have followed an affiliate link used within our online offer. The assignment of the affiliate links to the respective business transactions or to other actions (e.g. purchases) serves the sole purpose of the commission statement and is canceled as soon as it is no longer required for the purpose.

For the purposes of the aforementioned assignment of the affiliate links, the affiliate links can be supplemented with certain values that are part of the link or can be stored in some other way, e.g. in a cookie. The values can include, in particular, the source website (referrer), the time, an online ID of the operator of the website on which the affiliate link was located, an online ID of the respective offer, the type of link used, the type of offer and an online identifier of the user.

The Shariff Wrapper only communicates with the respective social network after the user has actively clicked on the link. So we save no datas on our site. After click Social Media are responsible for your datas. More information about the Shariff Wrapper Plugin can be found at WordPress https://de.wordpress.org/plugins/shariff/

Plugins and embedded functions and content

We integrate functional and content elements into our online offer that are obtained from the servers of their respective providers (hereinafter referred to as “third-party providers”). This can be, for example, graphics, videos or city maps (hereinafter uniformly referred to as “content”).

The integration always requires that the third-party providers of this content process the IP address of the user, since without the IP address they could not send the content to their browser. The IP address is therefore required for the display of this content or functions. We endeavor to only use content whose respective providers only use the IP address to deliver the content. Third-party providers can also use so-called pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. The “pixel tags” can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information can also be stored in cookies on the user’s device and contain, among other things, technical information about the browser and the operating system, websites to be referred to, the time of the visit and other information on the use of our online offer and can also be linked to such information from other sources.

Services and service providers used:

WP Cerber Security & Antispam

We use the “Cerber Security & Antispam” service provided by Cerber Tech Inc. New York, NY, 1732 1st Ave, 10128, USA. The hacker protection plugin blocks intruders by IP or subnet and protects against further attempts when a set limit of retries is reached. This makes brute force attacks or distributed brute force attacks from botnets impossible. In addition, by creating an IP blacklist or whitelist, it is possible to block or allow logins from specific IP addresses. (More information about the functions at: https://wpcerber.com/). According to the provider, no data is collected or processed in this context – neither by the services nor by the software offered.

More information on the collection and use of data by WP Cerber Security & Antispam can be found in Cerber’s data protection information: https://wpcerber.com/privacy-policy/

VG Wort

Our offers use tracking pixels from the collecting society WORT, Goethestrasse 49, 80336 Munich (“VG Wort”). Tracking pixels are graphics within the respective website that are invisible to you as a website visitor, whereby information about visitor traffic on our offers can be evaluated. VG Wort administers the royalties from secondary exploitation rights to language works for authors. The distribution of royalties for online texts is tied to certain criteria. VG Wort uses the data collected via tracking pixels to determine whether a text on a website has reached the threshold required for distribution.

According to VG Wort, the process used ensures that individual users or their reading behavior cannot be determined when the number of text views is counted, since all data recorded by VG Wort is immediately and securely encrypted. The use of the tracking pixel was assessed by the Bavarian State Office for Data Protection Supervision and rated as data protection compliant.

Children’s Information

Another part of our priority is adding protection for children while using the internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity.

Expats in Germany does not knowingly collect any Personal Identifiable Information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.
